With the Application
for U.S. Federal Trademark
Registration + U.S. Comprehensive Trademark Availability Search package, the
first part of our service consists in performing a trademark availability
search.
If at the first and most important level, the U.S. Federal
level, we find a full conflict (exact match conflict) with a trademark
already registered, or pending registration, we suspend the search, and notify you of
such a conflict.
Following this notification, you will have the following
options:

Get full refund of the $290; |

2. |
Get the search completed
anyway for brand building purposes (to see what is in the
market, and make your trademark distinctive, eventually keeping some of the
original elements of it); |

3. |
Provide a different, new trademark on which to have the trademark availability search performed. |

Why would you have a search performed all the way down, when at the first and most important level is found a conflict that would cause your trademark to be refused registration for likelihood of confusion, and use of your trademark could be an infringement? For this refund to be granted, it must be requested to our customer service center within 60 days from the date of the notification of the conflict. If the refund is not requested within 60 days from the notification of the conflict, the $290 will remain a simple credit on your account for the same type of trademark service.

After having paid the $290 for the Application
for U.S. Federal Trademark
Registration + U.S. Comprehensive Trademark Availability Search package, and having
received the complete trademark availability search report (no exact match
conflicts were found) showing conflicts based, for example, on sound; if, to
avoid any risk of refusal for likelihood of confusion, or infringement problems,
you decide not to proceed in filing the
application for registration, you can request a refund of the application costs ($90).
For this refund to be granted, it must be requested to our customer service center within 60 days from the date of the receipt of the search report. If the refund is not requested within 60 days from the receipt of the report, the amount of $90 (application costs) will remain a simple credit on your account for an equivalent trademark service.
